Another case that I resolved a couple weeks ago was regarding a young man, who was dropping his daughter off at school, had walked around the back of his car and the car in front of him, instead of pulling forward, backed up into his car. His car ended up impacting with him. He tried to keep working, tried not to let it affect him, but eventually had to go on to have a microdiscectomy, which is a surgery with the lower back where they just trim the disc up a little bit.
He had a very nice result, but the insurance company for the car that struck him was finding every reason they possibly could not to negotiate with us. I had to sue the case. I had to get in before a judge. We had a mediator involved. It took me researching and providing jury verdict results for them to let the insurance company know why they were valuing this thing so low and that they should see things my way as far as value goes.
We were eventually successful in getting the insurance company to make a policy limits offer on this file, even though for the past year and a half they were really trying to not ignore it, but to negate any positive points that we had regarding our case, and to focus on any smaller minor inconsistencies in the medical records or in how my client reported it happened. All those things really fell to the wayside once push came to shove, and we were able to resolve it.
