I had a case recently go to trial in the New York State Court of Claims. The Court of Claims is a special court that only hears cases where the State of New York is a defendant. In this matter it was a motor vehicle accident. It was tried to conclusion by one of my partners. In this case the State had taken the position that our client’s injuries were not caused by the motor vehicle accident. More importantly, they had indicated that if the injuries were caused, it was just an exacerbation of a pre-existing condition.

I had an extensive trial before the Supreme Court judge and ultimately in that case the judge came back with a decision that not only were the injuries causally related to the accident, but the plaintiff in this case was entitled to an award of approximately $1.5 million.
