What is the statute of limitations for a child sexual abuse case in New York?
Survivors ask how long they have to bring their child’s claim in New York State if they’re abused by a priest or a teacher. The law, as it is going to go forward, is anybody who is abused after this law takes affect is going to have until they’re age 55 to bring a civil lawsuit, and until age 28 to file criminal charges. The act also applies and opens up a one-year window to bring claims now that may be quite old and may have been barred by the previous statute of limitations.
