In New York State, the statute of limitations for infants and adults is the same. However, the date when the statute of limitations starts to run for children is delayed – or tolled –until they reach the age of majority which, in New York State, is 18. Depending on the type of case, New York State’s statute of limitations can be one year, two years, two and a half years, or three years. In a negligence case, the statute of limitations starts to run when the infant hits the age of 18 and runs for three years, expiring on their 21st birthday.
