Statute of Limitations for Children

  • While New York State’s statute of limitations for infants and adults is the same, the time when the statute starts to run for children does not begin until they reach the age of majority.
  • Variable by type of case, New York State’s statute of limitations can be one year, two years, two and a half years, or three years.
  • In a negligence case, the statute of limitations starts to run at the age of 18 and runs for three years, expiring on the infant’s 21st.

First Steps After Your Child Has Been Injured

  • If your child is seriously injured, the first thing to do is seek any necessary medical attention.
  • Talking with insurance companies about those injuries is discouraged, because the insurance company’s primary goal is to gather information it can use against you later. Instead, call on an attorney to get involved on your child’s behalf by making sure all required documents are filed and all relevant laws are obeyed.

Can a Child Bring Forward a Claim for Another’s Negligence?

As a dedicated Buffalo Personal Injury Lawyer, I am often asked if a child can bring a claim against the negligence of another person in an accident.

  • New York State grants a child the same opportunity to bring a personal injury claim as an adult.
  • Although most 17-year-olds don’t want to be called an infant, prior to the age of 18, New York State considers them as such.
  • Infants may bring a claim; however, it must be done through a parent, custodian, or guardian.
