It’s increasingly common to get phone calls from people who are seriously injured in a car crash where the other vehicle does not have adequate insurance to cover their losses. In New York state right now, the minimum insurance required for a private operator is $25,000 per person, per accident. That becomes woefully inadequate if there are, really, any level of injuries, especially if they’re serious injuries.

What can happen at that point is, as long as you have purchased better insurance to protect yourself and your family under your own policy, through the supplemental uninsured, underinsured endorsement, once the other insurance company for the car that causes the accident offers their policy limits, we have to get permission from your own insurance carrier if your limits were higher. Then, we can begin negotiating, actually, part two of the pain and suffering bodily injury case with our own insurance company, if that insurance is needed because the injuries were serious enough, and if adequate insurance is purchased.

That’s why I always recommend to take a look at your insurance policy. Take a look at the endorsements, not only for the bodily injury coverage and your collision coverage, but also what’s important is the SUM coverage, which we mentioned. Also, when you look at that insurance policy, you want to make sure that you have adequate coverages for your no-fault coverage. The other car that causes these injuries – even if they have minimal coverage but you have purchased better no-fault coverage for yourself, and better underinsurance for yourself, you still have a chance to be adequately compensated through your own carrier.
